Florida’s Statute §316.083 addresses the steps that are required by law when passing on two-lane roads. Passing vehicles in front of you on a two-lane rod or highway, such as Florida State Road 105, (Heckscher Drive) can be very dangerous. Knowing the required steps to take before passing a vehicle will allow you to do so safely and legally.

According to this statute, before merging into the oncoming traffic lane to pass the vehicle in front of you, an appropriate signal must be provided. An appropriate signal must be given by hand, arm or by your vehicle’s signal lamps. Once you signal and verify that there is no oncoming traffic, you may then accelerate and pass. After you have passed the vehicle, and there is a safe distance between your vehicle and the vehicle you passed, you can safely merge back into the lane in front of the vehicle you passed.

If you are driving the vehicle being passed, it is advised that you signal the vehicle that is passing your vehicle to indicate that you are aware of their intentions and there is a safe amount of distance between the two vehicles.

The same statute applies when passing a slower moving personal transportation such as a scooter, bicycle or an electric bicycle. As the passing driver, you should leave a safe distance between your vehicle of no less than three feet.
