In the state of Florida, the term time-sharing is used instead of custody and visitation. Your time-sharing arrangements are when your child spends time with each parent. The court will order a time-sharing schedule that is in the best interests of the children while taking into consideration factors in the Florida Statute 61.13.

A parenting plan approved by the court must, at minimum describe:

  • How the parents will share and be responsible for the daily tasks associated with the upbringing of the child
  • Include the time-sharing schedule arrangements that specify the time that the minor child will spend with each parent
  • Designate who will be responsible for any forms of health care
  • School-related matters

There is no presumption for or against the father or mother of the child or for or against any specific time-sharing schedule when creating or modifying the parenting plan of the child. With that being said, it also states in the Florida Statute that the court shall order sole parental responsibility for a minor child to one parent, with or without time-sharing with the other parent if it is in the best interests of the minor child.

Determining the best interest of the child is demonstrated but not limited to the capacity and disposition of each parent to facilitate and encourage a close and continuing parent-child relationship, to honor the time-sharing schedule, and to be reasonable when changes are required.
